RULE 05.2 - PROHIBITED LIST

The following risks may not be submitted. These risks are also unacceptable for renewal business.

1. Does not have a valid AAA membership (also required for policy renewal).

2. Policies without proof of prior dwelling or contents coverage. An exception may be allowed for first time buyers.

3. Applicants with fire, theft, liability, or negligence claims within the past 3 years are unacceptable. 1 claim within the last 3 years, caused by nature, may be submitted if the claim was less than $5,000 and the damage has been repaired.

4. Rooming or boarding houses, on and off campus student housing, including but not limited to dormitory, fraternity and sorority housing.

5. Applicants with more than 2 student roomers.

6. Mobile homes, travel, tent or 5th-wheel trailers, whether or not set on blocks, foundations or otherwise made stationary.

7. Modular homes located in mobile home parks.

8. Modular homes built or placed on other than a continuous concrete perimeter foundation.

9. Buildings of the commercial or mercantile type.

10. Condominiums or cooperative units. Townhouses are prohibited if the entire building is not owned by the insured.

11. Risks with serious exterior/interior exposures, whether natural or artificial, on the insured location exposing persons or property to an unreasonable risk of harm.

12. Applicants who have had past convictions of crimes for the coverage(s) provided, such as arson, fraud, etc.

13. Dwellings constructed with nonconventional building materials such as foam, plastics, eifs (synthetic, fake stucco) or with unusual features, including underground structures, dome houses, log houses.

14. Shell homes and/or "Do-it-yourself" construction unless the applicant is a professional craftsman and wiring, heating, etc., are installed by appropriate professionals in compliance with established building codes. In instances involving professional craftsmen, refer to the Underwriting Department prior to binding and indicate the anticipated completion date.

15. Dwellings with non-continuous foundations, unless enclosed to prevent the accumulation of debris under the structure. Piered homes must be less than 3 feet from the ground.

16. Dwellings with concrete block foundations not reinforced with rebar.

17. Dwellings with post construction where any portion of the living area is supported by one or more posts or columns. Post construction may be acceptable if the dwelling is located on level ground or the posts or columns supporting the living space are not located along a driveway.

18. Any deck supported by posts may not have any combustible material located under or near the structure.

19. Basement dwellings.

20. An insured premises which is vacant or unoccupied for more than 30 days.

21. Residences which are inaccessible, i.e., emergency vehicles are unable to reach them at any given time of the year and/or are 1/2 mile or more off a paved road.

22. Dwellings located in commercially zoned neighborhoods or adjacent to commercial property.

23. Seasonal risks as follows:

A. Beach properties.
B. Dwellings used primarily as rooming or boarding houses during the vacation season.
C. Dwellings located in congested resort neighborhoods.
D. Dwellings with serious brush exposures.
E. Dwellings that are not easily accessible, except for periodic heavy snow conditions.
F. Mobile homes.

24. Applicants whose premises, including other structures on the property, indicate poor maintenance, are in a rundown condition, lack good repair or conditions exposing persons or property to an unreasonable risk of harm. (For example: inoperable automobiles stored in the yard or poor standard of maintenance or repair, or broken steps, etc.)

25. Any structure on the insured location used as a living space but that does not comply with all applicable building ordinances and laws. This includes, but is not limited to, garages and other structures being used as a living space without all proper permits.

26. Residences where major appliances are kept outside of the dwelling.

27. Applicants who are unable or unwilling to follow reasonable safety or loss control recommendations.

28. Residences with unusual or hazardous attractions for children including, but not limited to, unguarded excavations, open wells, swimming pools, trampolines and/or skateboard ramps.

29. Residences where horses are boarded.

30. Persons engaged in any illegal business.

31. Persons convicted of illegal use of narcotics or alcohol.

32. Property where alcoholic beverages are sold.

33. Dwellings where primary source of heat is a wood stove or space heater. Dwellings must have central heating.

34. Improperly installed supplemental heating units such as, but not limited to, wood stoves, kerosene heaters, etc.

35. Dwellings with unrepaired damage.

36. Risks that have any of the following characteristics:

A. Abnormal Burglary or Theft Exposure.

1. Lack of adequate locks or other precautions against theft.
2. Frequent or extensive travel.
3. Frequent or extensive entertaining by the tenants of the dwelling.
4. Located in high crime areas unless one of the following is met:

a) All entrances and exits are monitored and controlled by security guards on duty 24 hours a day, or;
b) The building has a central station alarm system that reports directly to an alarm company or to a police station.

B. Abnormal Liability Exposure.

1. Broken, sagging or unsupported or unsafe steps or stairs.
2. Poor maintenance of sidewalks, porches and other areas.
3. Porches or decks more than 2 feet off the ground without guard railings.
4. Door openings over 2 feet off the ground without a staircase with guard railings to the ground or opening to a deck without guard railings attached to the home.

37. Rental dwelling premises where the primary homeowners, condominium or renters policy is not insured through an ACE affiliate (including the Auto Club Family Insurance Company).

38. Residences converted from one-to-four family dwellings to apartment units.

39. Dwellings with more than three (3) stories.

40. Residences with more than four (4) attached units.

41. More than two (2) layers of roofing materials of any kind.

42. Any roofing material placed over wood shingles or wood shake roofs.

43. Dwellings which are undergoing extensive remodeling.

44. Dwellings used for commercial or business purposes.

45. Farming as a primary occupation. Incidental farming will be considered with prior underwriting approval.

46. Dwellings with less than 100 amp electrical service.

47. Dwellings with knob and tube wiring.

48. Dwellings with a slate or tile roof.

49. Dwellings with a flat roof over the main dwelling structure. This does not apply when the flat roof is only over the garage, carport, sunroom, etc.

50. Dwellings when the second layer of roofing material is composition shingle over a wood roof.

51. Dwellings when the second layer of roofing material is wood over a wood roof.
